Terms and Conditions

Effective Date: July 1, 2023

Our conditions are inline with the Swiss Code of Obligations Art. 184. These conditions are different to conditions found in the UK and the EU. 

**1. Introduction**

Welcome to The English Grocer (www.englishgrocer.ch). These terms and conditions govern your use of our website and the purchase of products from us. Please read the following terms carefully before placing an order. By using our website or placing an order, you agree to be bound by these terms.

**2. Ordering and Payment**

2.1. The English Grocer operates as a pre-order business, importing goods from England to Switzerland. Some goods may originate from Europe or Switzerland.

2.2. Payment must be made upfront for all orders. Goods will be delivered within an estimated 30 days from the payment date (not the order date). However, in accordance with the laws of Switzerland, we do not provide for any maximum delivery time.

2.3. A cancellation fee of 25 CHF will be applied on all orders canceled by the customer after the time the order has been placed. 

2.4 Customers may pay for their order via Credit/ Debit Card or Bank Transfer. Invoices may be sent to the customer via e-mail or SwissPost. 

2.5 Reminder fees will apply after 14-days and 28-days. This will incur a fee of 15 CHF. 

**3. Delivery of Goods**

3.1. Delivery times may vary and are subject to availability. We will make every effort to ensure timely delivery. Please use our delivery calendar function to view our estimated shipment dates.

3.2. The English Grocer is not responsible for delays due to factors beyond our control, including but not limited to customs processes which may delay individual or grouped consignments. 

3.3. In accordance with best practice policies you can use the order status tool here to see where your order is. We do not guarantee the accuracy of this third-party tool.

3.4. The English Grocer refuses all liability for delivery damages sent via SwissPost, UPS, DHL or any other courier. 

3.5. In the event of your absence during a delivery attempt marked as "failed," we may make a subsequent delivery attempt. The cost of this re-delivery (2nd delivery) will be either the original delivery charge you paid or to 10 CHF, whichever amount is greater. The charge will come as a payment request or invoice with our general invoice terms being applied. 

**4. Import Duties and Taxes**

4.1. All Swiss import duties and taxes will be paid by The English Grocer. The client is not liable for any Swiss import duties or taxes.

4.2. We do not burden import duties outside of the European Union or Switzerland in the price advertised. 

**5. Returns**

5.1. We do not accept any food returns except in the case of damaged or defective goods. Please contact us within a maximum of 48 hours of receiving your order if you encounter any issues.

5.2. For missing, damaged or defective goods or warranty: If a product presents a defect or does not offer the promised characteristics, the buyer has two years in which to file a warranty action. 

**6. Privacy**

6.1. We respect your privacy and handle your personal information in accordance with our Privacy Policy, which can be found on our website.

**7. Contact Information**

We do not have a physical shop or location open to the public. Our premises are for picking and packing only. We do not offer a collection service at this time.

**8. Changes to Terms and Conditions**

8.1. The English Grocer reserves the right to update or modify these terms and conditions at any time without prior notice.

**9. Governing Law**

9.1. These terms and conditions are governed by and construed in accordance with the laws of Switzerland.

**10. Refunds**

10.1. All sales are final.

10.2. Refunds will be issued in the form of store credit, valid for a period of 3 months via your customer account. If you cannot see or apply your store credit it will be applied to your order manually. 

10.3. Store credit may be extended at the discretion of the management and upon request.
